In 2025, the State of New York launched a sweeping restructuring of its Consumer Directed Personal Assistance Program (CDPAP) — a move that has sent shockwaves through the home care industry and displaced tens of thousands of caregivers. Designed to “streamline” administration, the state eliminated over 600 community-based Fiscal Intermediaries (FIs) and handed all CDPAP responsibilities to a single private contractor: Public Partnerships LLC (PPL).

The transition has not gone smoothly. Widespread delayed payments, disrupted care, and legal battles have left many caregivers with no choice but to exit CDPAP and pursue work as Home Health Aides (HHAs) or Personal Care Aides (PCAs) through traditional home care agencies.


🔁 What Changed With CDPAP in 2025?

Effective April 1, 2025, CDPAP consumers and caregivers were instructed to switch entirely to PPL for payroll, onboarding, and administrative support. The state claimed this consolidation would reduce Medicaid costs by hundreds of millions of dollars.

But the reality on the ground tells a different story:

  • Thousands of caregivers missed paychecks

  • Consumers experienced gaps in care

  • PPL’s infrastructure failed to absorb the volume of users, with long wait times, portal crashes, and unanswered support requests

The human toll has been enormous. Many caregivers are reporting burnout, financial hardship, and frustration, while consumers—especially seniors and disabled individuals—have been left confused and without reliable help.


⚖️ Two Major Legal Battles — and One Still Ongoing

There are two separate legal fights unfolding over the CDPAP transition.

1. Engesser et al. v. McDonald

This case, filed by CDPAP consumers and advocates, challenged the implementation process, arguing that it was rushed and posed serious risks to consumer safety.

Result: A preliminary injunction was granted, delaying full enforcement and extending deadlines for enrollment and caregiver onboarding.

2. The Constitutional Challenge (Ongoing)

In a separate lawsuit, a coalition of Fiscal Intermediaries and affected stakeholders are challenging the law itself — arguing that the 2025 CDPAP policy violates the U.S. Constitution.

Key legal claims include:

  • Contracts Clause Violation – The abrupt cancellation of legally binding contracts with FIs constitutes unlawful interference.

  • Takings Clause Violation – The state expropriated business value, infrastructure, and contractual rights without compensation.

  • Due Process Violations – The law fundamentally disrupted services without proper notice, hearings, or recourse.

❗ This constitutional lawsuit is ongoing and has not yet resulted in an injunction, but it continues to make its way through federal court with growing support from legal and healthcare advocacy groups.


💸 Will the State Even Save Money?

One of the most glaring issues is the questionable math behind the state's promise of cost savings.

Here’s what critics are pointing out:

  • Administrative chaos has created massive inefficiencies and lawsuits

  • PPL’s pricing and profit margins are not publicly transparent

  • The state may now bear new long-term liabilities from lawsuits, missed care, and Medicaid penalties

  • Valuable infrastructure from hundreds of community-based FIs has been destroyed — with no backup plan

In short, the claimed savings may never materialize, and New York could be left with a more expensive, less effective, and legally risky program.
